RAM Paper & Office Products Pty Ltd reserves the right to accept any order in whole or in part.
7. Some products may not be available in all states. Any failure of our suppliers to deliver in accordance with the description or sample may result in some products being unavailable. Similar quality products may be substituted if unavailable.
8. Where RAM Paper & Office Products Pty Ltd has agreed to procure and/or warehouse and/or distribute Products specifically for the Customer, the Customer must, within 30 days of request, purchase all stock then warehoused and held at the then prevailing supply price.
9. RAM Paper & Office Products Pty Ltd reserves the right to recover from the Customer all GST payable in respect of the supply of goods and services to the Customer.
Delivery
10. RAM Paper & Office Products Pty Ltd reserves the right to charge for delivery of the Products at any time, notwithstanding that it may not have previously done so. Administrative fees may also be imposed for orders under certain dollar values.
Product Descriptions & Images
11. All product descriptions and images, which appear at rampaper.com.au or in our paper catalogue, are correct and current to the best of RAM Paper & Office Products Pty Ltd's knowledge. However, the product image may on occasions differ from the actual products.
Cancellations
12. Orders may be cancelled by calling your local RAM Paper & Office Products branch. However, orders cannot be cancelled once the order is in transit to the customer's premises. In such instances, customers must accept the order upon delivery, but may contact the local RAM Paper & Office Products branch after delivery to arrange a return of the goods. A restocking or return fee maybe charged to the customer.
Payment
13. All credit orders are accepted by RAM Paper & Office Products Pty Ltd subject to satisfactory credit approval of the Customer, which may be withdrawn at any time. Where credit approval has not been granted, or is withdrawn, payment for all Products supplied is required on delivery. Where credit has been granted, payment for the Products is to be made on or before 30 days from the date of invoice. Payment must be made in full without set off or deduction. RAM Paper & Office Products Pty Ltd will investigate any disputed amounts, and if resolved in favour of the Customer, a credit will be issued to the Customer.
14. Any expenses, cost or disbursements incurred in recovering outstanding monies from the customer, including debt collection agency fees and solicitors' costs shall be paid forthwith on demand.
Returns & Refunds
15. Any goods, which are damaged or defective, delivered after their "use by" or "best before" date, or which are not otherwise in accordance with the Customer's order, may be returned to RAM Paper & Office Products Pty Ltd within 30 days of delivery, at no cost to the Customer. The Customer may otherwise return goods (excluding specially purchased goods, goods specifically tailored for the Customer's requirements, IT consumables, furniture and food products) to RAM Paper & Office Products Pty Ltd we will gladly provide a credit or exchange:
a. provided that it done so within 30 days of delivery and a return authorisation is obtained from RAM Paper & Office Products Pty Ltd;
b. provided that the goods are in their original packaging, unopened, of a current make and model, and otherwise as new and in a saleable condition;
c. at the Customer's own expense, or to the Customer's account; and
d. on the basis that risk in the goods remains with the Customer until the goods are received by RAM Paper & Office Products Pty Ltd, and that a restocking or return fee may be charged.
Liabilities & Warranties
16. RAM Paper & Office Product Pty Ltd accepts no liability for the Customer's security breaches, unauthorised use of the Customer's credit account, fraud, forgery or mistaken or unauthorised orders or payments.
17. RAM Paper & Office Products Pty Ltd reserves the right to revoke access to our website http://www.rampaper.com.au at any time.
18. The Customer's password and access details are strictly confidential information and must not be disclosed to, or used by, any person except for those employees of the Customer with a "need to know" for the purposes of placing orders with RAM Paper & Office Products. The Customer must release all confidential information to RAM Paper & Office on termination of its relationship with RAM Paper & Office Products.
19. Ownership of the Products does not pass to the Customer until the Customer has discharged all outstanding indebtedness, whether in respect of the Products or otherwise, to RAM Paper & Office Products Pty Ltd. Risk in the Products will pass on delivery to the Customer.
20. Apart from stated above, RAM Paper & Office Products Pty Ltd shall not be under any liability to the Customer in respect of any loss or damage (including consequential or indirect loss or damage or loss of profits) however caused, which may be suffered or incurred or which may arise directly or indirectly in respect of the Products, any services supplied by RAM Paper & Office Products Pty Ltd or the failure of RAM Paper & Office Products Pty Ltd to comply with these terms and conditions.
21. RAM Paper & Office Products Pty Ltd reserves the right to change these Terms and Conditions at any time on 14 days notice.
Applicable Law
22. These terms and conditions are governed by and will be construed in accordance with the laws of the State or Territory in which the order is placed and the parties agree to submit to the jurisdiction of the courts of that State or Territory.
Privacy
23. Any personal information submitted by the customer when conducting business with RAM Paper & Office Products Pty Ltd will be treated confidentially, but may be used by all RAM Paper & Office Products Pty Ltd related branches for marketing purposes and/or to assist us in improving service to you.
24. RAM Paper & Office Products Pty Ltd does not rent or sell personal information about customers or customer lists to third parties.
